Terms of Service

1. Acceptance of Terms

By accessing or using the SafeModeration API ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

SafeModeration provides an API-based content moderation service that analyzes text and other content and returns moderation signals and decisions. The Service is provided on a subscription basis.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your API keys and account credentials. You must promptly notify us at support@safemoderation.com if you believe your account or API key has been compromised.

4. Acceptable Use

You may not use the Service to:

  • Violate any applicable law or regulation
  • Moderate or process content that is illegal to possess or distribute
  • Reverse engineer, decompile, or attempt to extract underlying models or algorithms
  • Resell, sublicense, or provide API access to third parties without written permission
  • Interfere with or disrupt the integrity or performance of the Service
  • Circumvent rate limits or security protections
  • Use the Service in a manner that creates risk, harm, or liability for SafeModeration or other users
  • Use the Service or its output in connection with practices prohibited under Regulation (EU) 2024/1689 (the "EU AI Act"), or as part of any system classified as high-risk under the EU AI Act, except where expressly authorized by SafeModeration in writing.

By submitting content through the Service, you represent and warrant that: (a) you have all necessary rights, licenses, consents, and permissions to submit that content for moderation; (b) your submission and our processing of the content does not violate any applicable law or any third party's rights; and (c) where applicable, you have provided required notices and obtained required consents from the individuals whose data is included in the content.

5. Moderation Decisions and Disclaimer

SafeModeration provides moderation outputs as a tool to assist your internal processes.

  • Moderation decisions are probabilistic, not deterministic
  • Outputs may be incomplete, inaccurate, or unsuitable for specific use cases
  • The Service is not a substitute for legal advice or regulatory compliance

You are solely responsible for your content policies, how you use moderation outputs, and compliance with applicable laws and regulations. SafeModeration does not guarantee that the Service will meet any legal or regulatory requirements.

6. Data and Privacy

Our handling of your data is described in detail in our Privacy Policy. In summary:

  • We store the content of your authenticated production API requests for one year, accessible to you through your dashboard.
  • We store image URLs but never the image bytes themselves.
  • We pass your content through our classification providers during processing. Our providers retain API data for up to 30 days for abuse monitoring; see our Privacy Policy for details.
  • We never use the content of your moderation requests as training data for AI or machine learning models, ours or any third party's. We may use anonymized aggregated quality metrics to evaluate and improve the Service.
  • We never share your content with other customers.
  • We never sell your data.

Refer to our Privacy Policy for full disclosure including retention periods, your rights regarding access and deletion, and the list of infrastructure providers we use.

7. Subscription and Billing

Subscriptions are billed monthly or annually in advance.

  • Plans include a defined number of credits per billing period
  • Unused credits do not roll over
  • If usage exceeds limits, the Service will return rate-limit errors (HTTP 429)
  • We do not charge overage fees

No refunds are provided for unused portions of a billing period.

Price Changes: We may modify pricing at any time. Changes will take effect at the start of your next billing cycle, with at least 30 days' notice.

8. Free Trial

New accounts may include a free trial. A valid payment method is required to start a trial. You will be charged at the end of the trial period unless you cancel before it ends.

9. Cancellation

You may cancel your subscription at any time via your account or by contacting support@safemoderation.com. Cancellation takes effect at the end of the current billing period. Access to the Service will terminate at that time.

10. Intellectual Property

SafeModeration retains all rights, title, and interest in and to the Service, including all software, models, algorithms, and underlying technology. Use of the Service does not grant you ownership of any part of the Service.

We may use aggregated usage statistics — including request volumes, latency measurements, decision distributions, category frequencies, and quality metrics (accuracy rates, false-positive rates) in anonymized form — to evaluate and improve the Service. We never use the content of your moderation requests, your moderation results, or any customer-supplied identifiers (reference_id, metadata) as training data for AI or machine learning models, ours or any third party's. Aggregated statistics never include content from individual moderation requests.

11. Marketing and Publicity

You grant SafeModeration LLC a non-exclusive, worldwide, royalty-free right to use your company name and logo to identify you as a customer on our website and in marketing materials. You may opt out of this use at any time by providing written notice to support@safemoderation.com. We will request your prior written consent before publishing case studies, testimonials, or detailed descriptions of your use of the Service.

12. Indemnification

You agree to defend, indemnify, and hold harmless SafeModeration LLC and its affiliates, officers, and employees from and against any claims, damages, liabilities, losses, and expenses (including legal fees) arising from your use of the Service, your content or platform, your violation of these Terms, or your violation of applicable law or third-party rights.

13. Limitation of Liability

To the maximum extent permitted by law, SafeModeration LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the three (3) months preceding the claim.

14. Warranty Disclaimer

The Service is provided "as is" and "as available" without warranty of any kind. We do not warrant that the Service will be uninterrupted or error-free, that outputs will be accurate or reliable, or that the Service will meet your specific requirements.

15. Suspension and Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms, your use creates risk or harm, or we are required to do so by law.

16. Service Changes

We may modify, suspend, or discontinue any part of the Service at any time without liability.

17. Export Compliance

You may not use the Service in violation of U.S. export control laws or applicable sanctions regulations.

18. Changes to Terms

We may update these Terms from time to time. For material changes, we will provide at least 14 days' notice by email. Continued use of the Service after changes take effect constitutes acceptance.

19. Beta and Demo Services

From time to time we make new features available as beta releases or limited-access previews, and we offer a public demo at safemoderation.com/demo. Beta and demo services are provided "as is," without warranty of any kind. We may modify, suspend, or discontinue beta and demo features at any time without notice. Production API service-level expectations do not apply to beta or demo services.

The demo endpoint is rate-limited and intended solely for evaluation. Use of the demo for production traffic, commercial purposes, or to circumvent paid plan limits is prohibited.

20. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.
